Agreement
These terms apply to this website and to the coaching services offered by Fierce By Design Coaching ("Fierce By Design," "I," or "me") in Twin Falls, Idaho. By using this site or enrolling in a program, you agree to them. If you don't agree, please don't use the site or the services.
What the service is
Fierce By Design provides one-on-one health and wellness coaching, nutrition coaching, and personal training. What I offer is education, programming, and accountability.
I am a coach and personal trainer — not a physician, nurse, therapist, counselor, psychologist, or registered dietitian. Nothing I provide is medical care, mental-health treatment, or medical nutrition therapy, and nothing I provide diagnoses, treats, cures, or prevents any condition. Please read the full disclaimer, which is part of these terms.
Sessions, scheduling, and cancellation
Sessions are scheduled by agreement between us. If you need to move or cancel a session, let me know at least 24 hours ahead and we’ll reschedule it at no cost. A cancellation inside 24 hours, or a missed session, counts as a used session — that time was reserved for you and I can’t give it to someone else on short notice.
If you’re running late, we’ll use whatever time is left; the session still ends at its scheduled time. If I ever have to cancel on you, that session comes back to you — rescheduled or credited, your choice.
I’ll confirm these terms with you in writing before you enroll, and they apply from that point forward.
Pricing, payment, and refunds
Program prices shown on Work With Me are current at the time of posting and are subject to change. A price change never applies retroactively to a program you have already paid for.
Payment is not taken on this website — nothing here is a checkout, and I don't collect card or bank details through this site. Billing is arranged directly with me.
Coaching programs are billed monthly in advance and renew automatically until you cancel. You can cancel any time before your next billing date — just tell me in writing — and you keep full access through the period you’ve already paid for.
Because your coaching time is reserved for you ahead of schedule, I don’t refund a month that has already started, and unused sessions don’t roll over into the next month unless we agree otherwise. If I’m ever unable to deliver a program you’ve paid for, I’ll refund or credit the unused portion — that one’s on me, not you.
Prices shown on this site are current and may change. If a price changes, I’ll tell you before it affects what you’re paying. I’ll confirm your payment schedule and accepted methods in writing before you enroll.
What I ask of you
Coaching only works if I'm working with accurate information. By enrolling, you agree to:
- Tell me honestly about your health history, injuries, medications, allergies, pregnancy, and anything else that could affect your safety in a nutrition or exercise program — and to keep me updated if it changes.
- Get clearance from your physician or other qualified healthcare provider before starting, especially if you have a medical condition, an injury, are pregnant or postpartum, or are taking medication.
- Stop and seek medical attention if you feel pain, dizziness, shortness of breath, or anything else that feels wrong — during a session or on your own.
- Use your own judgment about what your body can safely do on any given day.
- Be 18 or older — I coach adults only.
Assumption of risk
Physical exercise carries an inherent risk of injury — including muscle strains, joint injury, and, though rare, serious cardiac events. Nutrition changes affect people differently. You participate voluntarily, and you accept those risks. If something doesn't feel right, stop.
No guaranteed results
Results depend on your body, your history, your consistency, and factors outside anyone's control. Any result described on this site is one person's experience, not a promise. I don't guarantee any specific outcome — in weight, body composition, performance, or health.
My materials
Program designs, meal and nutrition guidance, workout plans, worksheets, written content, and anything else I create belong to me. You may use them for your own personal, non-commercial use as my client. Please don't copy, resell, publish, or share them with others, or use them to run your own coaching business.
Everything on this website — text, images, logo, and design — is likewise mine and may not be reproduced without permission.
Limitation of liability
To the fullest extent Idaho law allows, Fierce By Design is not liable for indirect, incidental, or consequential damages arising from your use of this website or participation in a program, and my total liability for any claim is limited to the amount you paid me for the services the claim relates to.
This does not limit any liability that cannot be limited by law. Nothing in these terms asks you to give up a right you can't legally give up.
Third-party links
This site may link to other websites or resources I don't control. I'm not responsible for their content, their accuracy, or their privacy practices.
Ending our work together
Either of us can end the coaching relationship. I may decline or discontinue services if continuing wouldn't be safe or appropriate — for example, if a concern is outside my scope and belongs with a medical professional. Any money already paid is handled under the payment and refund terms above.
Privacy
How I handle the information you send me is described in the Privacy Policy.
Governing law
These terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules.
Changes to these terms
I may update these terms. When I do, I'll post the new version here and change the "last updated" date at the top of this page — the version posted here, with that date, is the one that governs. Continuing to use the site or services after a change means you accept the updated terms.
